Through a new lawsuit, Mark Anthony International, a business that sells the Mas+ by Messi drink, says that Prime Hydration is “anti-competitive.”
Lionel Messi, a player in Major League Soccer, started a new drink company called Mas+ by Messi in June. It comes in bottles and cans and has four different tastes.
Right away, Logan Paul and KSI’s fans noticed how Mas+ looked a lot like Prime Hydration. They called the brand out on X for being a “ripoff” of the sports drink.
Mark Anthony International, which sells Mas+ by Messi, sued Prime Hydration on October 8, 2024, asking for a declaratory ruling to make sure Mas+ isn’t copying Prime’s bottle design.
Mark Anthony says in the case that Prime told the drink distributors soon after the launch that they couldn’t sell Mas+ by Messi until they changed the packaging. The distributor also says that Prime has said it will fight for trademark and trade dress infringement.
According to the lawsuit, Prime is “not only trying to stop fair competition but also is trying to monopolize functional packaging elements that are commonplace in the hydration beverage industry.”
It goes on to say that Mark Anthony called a “experienced survey expert” to see if there was a chance that people would mix up Prime and Mas+ by Messi.
“Not surprisingly, the survey showed that there was no chance of confusion between the two products, which added to Mark Anthony’s case that confusion is not likely,” it says.
Mark Anthony’s complaint goes into depth about how the two sports drink bottles are different and how marketing from Logan, KSI, and Messi helps people tell the brands apart. It talks about Logan Paul’s “many highly publicized scandals since his rise as a YouTube influencer” as one way that his work for Prime helps the brand.
For example, it says that he “published a vlog making fun of Japan’s Aokigahara” and “failed to release” CryptoZoo, his crypto video game.
“The public knows who Logan Paul is and can easily tell him and his business partners apart from Mr. Messi because of these controversies and other public stunts,” the suit says.
It was only a few days ago that Logan broke one of the most popular Prime Hydration claims since the product came out. On October 2, he said that the judge had thrown out the Prime Hydration “forever chemicals” case, which had been filed more than a year before.
